What is an Accessory Dwelling Unit (ADU)?

An Accessory Dwelling Unit (ADU) is a secondary living space on your property that includes its own kitchen, bathroom, entrance, and sleeping area.

Building An ADU in Massachusetts

The key points of Section 8, Chapter 150 of the Acts of 2024, also known as the Affordable Homes Act or ADU Law, introduced by Massachusetts Governor Healey in 2024, are:

  • Accessory Dwelling Units (ADUs) are allowed by right in single-family zoned districts
  • Municipalities are prevented from requiring zoning variances for the construction or rental of ADUs on parcels zoned for single-family homes
  • Owner-occupancy requirements for ADUs are prohibited
  • Municipalities may still require ADUs to comply with site-plan review, bulk and height limits, setbacks, and short-term rental bans
  • Municipalities are permitted to require one additional parking space for ADUs, except if the ADU is located within a half-mile from any commuter rail station, subway station, ferry terminal, or bus station
  • The law preempts almost all local authority and existing regulations on ADUs
  • Municipal bylaws must comply with the new ADU rules by February 2, 2025
  • The Executive Office of Housing and Livable Communities is promulgating regulations to ensure smooth implementation when this portion of the law goes into effect in February 2025

This law is part of a broader effort to address rising housing costs and increase housing production across Massachusetts.
